IYC hails Port Harcourt high court judgement,warn Alaye, group to let sleeping dogs lie

The Ijaw Youth Council (IYC) Worldwide has hailed and commended the Rivers State High Court Judgement for dismissing an application for interlocutory injunction against the Sir. Jonathan Lokpobiri, led Exco on the 2nd Day of July 2024.

The call was made in a statement signed and issued to newsmen in Yenagoa, on Tuesday by Amb. Princewill Binebai, Spokesman Ijaw Youth Council (IYC).

Hon. Justice C.N. Wali of the Rivers State High Court, Port Harcourt Judicial Division In its ruling, the court held that there cannot be two set of Executives for the Ijaw Youth Council at the same time yet the Claimants/Applicants are not entitled to the injunctive reliefs as they have not convinced the court to grant same in their favour.

According to him, “The court further held that in arriving at its decision, it holistically looked at the series of Affidavits and Counter Affidavits of Counsel for both parties including their legal arguments as contained in their written addresses as well as even the pleadings of both parties before the court.

The Spokesman said that the court reiterated that injunctive reliefs are for the preservation of the res which are perishable in nature but the administration of the IYC does not fall into this category.

IYC said that when interviewed by Pressmen shortly after the ruling was delivered, Obiri Ebilade Esq. who is Counsel for Jonathan Lokpobiri and his led Excos.

That the Defendants/Respondents in the suit, commended the court for the well considered ruling. He said the court resolved the the legal arguments he presented in his address in favour of his client to wit:

“That the Court cannot exercise its discretion to grant injunction to restrain an already completed act, adding that the Jonathan Lokpobiri led administration was elected on the 22nd day of July, 2023 by an elective convention held at the Gabriel Okara Cultural Center in Yenagoa Bayelsa and was adjudged as a free and credible election by all Stakeholders of Ijaw Nation.

“That the Court cannot be asked to grant interlocutory reliefs that will render the substance of the suit nugatory. In this case the Claimants are relying on the aborted Ataba Constitution while the Defendants are relying on the extant Ofunama Constitution of the IYC.

“As such granting their injunctive relief will indirectly mean the court is conceding to the aborted Ataba Constitution which did not follow due processes of constitutional amendment and was unanimously rejected by the IYC.

“The balance of convenience was in favour of the Defendants which are the Jonathan Lokpobiri led Exco because they are the legitimately recognized National Excos of the IYC and her in occupation of the Ijaw Youth Council Secretariat at the Ijaw House, Sani Abacha Yenagoa,” they said.

He further said the Claimants served the Defendants through a substituted means by pasting same at the IYC Secretariat.

“Pasting his usually at the last known address of the Defendant and as such the fact that the Claimants sought to serve the Originating Processes on the Defendants by pasting same at the IYC Secretariat is tantamount to conceding that the Defendants Sir Jonathan Lokpobiri and his led Excos are the ones in occupation of the IYC Secretariat.

“In all Ebilade Obiri Esq. said the ruling is well considered and has further reaffirmed the hope of the common man in the judicial system

“While the one and only IYC 9th National Executive Council (IYC) Worldwide led by Sir Jonathan Lokpobiri Snr as President has endured enough in tolerating these elements.

“We are warning that we will no longer tolerate any form of impersonation going forward from Dr. THEOPHILUS ALAYE and his group.

“Finally, let all structures of council take note and act accordingly as no other group of persons can be allowed to impersonate the 9th Executive Council of IYC.

“The Federal Government of Nigeria, Government agencies, Parastatals, State Governments, Ministries, commissions, companies and other stakeholders should take note,” the statement reads.
